Costumes[edit]

Hi! Sorry to bother you again. I'm not a native English speaking person so I would like to ask if I understand Commons:Copyright_rules_by_subject_matter#COSTUM correctly:

  • This is a complex situation
  • The safest would be to delete
  • However, concensus on Commons is that we accept files of people cosplaying

Looking at the old DR (Commons:Deletion requests/Files in Category:First Order Stormtroopers) I can see that many files are stil red (meaning deleted). Why is that if we accept cosplay?

The reason I ask is because Wikinews participated in an event and took a lot of photos. I wonder if they are okay to move to Commons or not. The files can be seen in n:Category:2017 Bangalore ComicCon (media).

I know there are a few files that are not costumes. For example n:File:2017 Bangalore ComicCon (media) IMG 0123.JPG and n:File:2017 Bangalore ComicCon (media) IMG 0123.JPG.

Most costumes are more like clothing, which is utilitarian. Masks on the other hand are not utilitarian, so costumes with masks get much riskier (especially if the photo is focusing on the mask). Certainly costume makers need to license the character copyright to produce the costumes, but a photo of the costume may not be a derivative work -- per Ets Hokins, a photo of a larger subject (maybe a group of people, or maybe even the person as a whole wearing the costume) should not be derivative -- just those focusing on the copyrightable object. It gets into a pretty gray area; photographers should have some rights to document everyday life etc. Interestingly, the stormtrooper helmet itself was ruled effectively utilitarian in the UK (though with a design right); it was however ruled sculpture in the US.[1]. Because of the US ruling though, photos which could be considered derivative of that mask would not be allowed here. There are many photos in your category which should be fine, but anything focusing on a sculptural mask would not be, and there are definitely a few in that category (and more that contain sculptural masks which get argumentative if they are focusing on it or not). Hi, thanks as always for the ship identifications! Just to check one, in the photos at Category:World Yachts Princess (ship, 1986), the ship has "La Barca Cantina" written on it. Perhaps a recent rename? Thanks. Mike Peel (talk) 19:59, 19 July 2023 (UTC)Reply[reply]

@Mike Peel: Sort of, that is the name of the restaurant now (https://labarcacantina.com ), but not sure they changed the official ship name (at least not that I found at the time). USCG still has the "world yachts princess" as the registered name. Similar if you search on the NOAA USCG Vessels site for 696423; they show a certificate issued in April under the World Yachts ship name. Carl Lindberg (talk) 22:59, 19 July 2023 (UTC)Reply[reply]

@Mike Peel: Yeah, it's a bit odd -- might have been interesting to see the stern, to see what the ship name is there. There are instances when the "marketing name" of a ship changes, but they don't bother to change the actual registration. Hi Carl, Could you please give your opinion about this case? Specifically, what a US court would say if a YouTube video have had a free license for 10 years (that's the case for a Microsoft game video which was deleted, as some people argued that the license is not valid)? The Australian copyright templates[edit]

Hello Carl, I realize that Real Life may have intervened recently and have not wanted to prevail on you any more in regard to the finalizing of the Australia copyright templates. Your help has been absolutely invaluable; there is no way I could have developed the templates without your feedback and guidance.

Despite Jimmyjrg (who has a coordinating role within Wikimedia Australia) asking Australian editors twice to comment and support/oppose, nobody has responded -- a pretty disappointing situation. I'm about to shake the tree on this.

Looking to implementation, however, I would be grateful if you could give me the benefit of your advice, one last time, on these matters:

  • You mentioned the "2026 situation". As I see it, uploaders will have to establish that the author has died, and that 70 years have elapsed since. Is there any other factor that I'm missing?
  • Do you know of a forum where I could attract the attention of a guru who could ensure the templates are updated competently? I have no experience in that area. In particular I'm aware that Auto translate and base= need to be addressed, but there may be others.
  • I'm unsure of how to arrange for the PD-AustraliaPhoto-1996 template to evade bots' requiring a separate US template.
  • Could you please add a "Support" comment?
